To give everyone an opportunity to be heard and to ensure the presentation of different points of view, the Planning Commission requests that members of the audience who wish to speak, complete a Speakers' Card and when called on: 1) Always address the Chair; 2) State your name; 3) State views succinctly; and 4) Limit presentations to three (3) minutes. However, if there is a large group present to speak on the same issue, the Planning Commission has the discretion to limit speakers to less than three minutes.

3. PUBLIC COMMENTS ON ITEMS NOT ON THIS AGENDA
This is the time for the Planning Commission to hear from citizens regarding matters that are not on the agenda. Except in very limited situations, state law precludes the Planning Commission from taking action on or engaging in discussions concerning items of business that are not on the agenda. However, the Planning Commission may briefly respond to statements made or questions posed by a member of the public, ask clarifying questions, make a brief announcement, or make a brief report on his or her own activities. The Commission may also refer matters not on the agenda to City staff or direct that the subject be agendized for a future meeting. Please make sure you have completed a Speakers' Card and turned it in to City Staff.

7.A Public Hearing and Recommendation on Amendments to the Municipal Code Adopting Title 10A (Objective Design and Development Standards)
7.B 16 Marie Street | Design Review Permit with Heightened Review Findings and Nonconformity Permit | Project ID: 2024-00248 | APN: 064-142-27 | Adam Blair, Associate Planner
SUMMARY: Applicant and Owner, Ann McIntire, is requesting approval of a Design Review Permit with Heightened Review Findings and a Nonconformity Permit to facilitate an exterior and interior remodel of an existing duplex structure which includes a new third story addition, a new entry addition, a new roof deck addition with an accompanying spiral staircase, small corner bump-out additions, and replacement of a rear nonconforming deck structure at 16 Marie Street (APN: 064-142-27). The project has been determined to be exempt from further environmental review under California Environmental Quality Act (CEQA) Sections 15301, 15303, and 15304. None of the exceptions to the use of a categorical exception in CEQA Guidelines section 15300.2 applies to the project, in that the project is not in a particularly sensitive environment; there are no indications that cumulative impacts of successive projects will cause significant impacts; it is not part of a state scenic highway; is not located at a hazardous waste site; and involves no historic resources.
RECOMMENDATION: Staff recommends the Planning Commission approve application 2024-00248 for 16 Marie Street and adopt the attached draft resolution approving the Design Review Permit with Heightened Review Findings and Nonconformity Permit.
7.C Ordinance Amending Chapter 10.44.080 of the Sausalito Municipal Code, Accessory Dwelling Unit Regulations I Matthew Mandich, Principal Planner
SUMMARY: Conduct a public hearing on proposed Zoning Ordinance Amendments and provide a recommendation to the City Council for their consideration during a regularly scheduled City Council meeting on November 18, 2025. The amendments are proposed to establish conformity with updated State ADU/JADU law (Government Code sections 66317, 66321, 66323, 66333, 66335), adopted under AB 1154, SB 9, and SB 543, which will go into effect on January 1, 2026. Amendments include changes to rental and owner occupancy and sprinkler requirements for JADUs, written appeal requirements, processing requirements and updated definitions to match state law. The amendments described above are categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21080.17 and Section 15282(h) of the CEQA Guidelines.
RECOMENDATION: Adopt the attached Resolution recommending City Council adoption of the proposed Zoning Ordinance Amendments, or direct staff to make changes to the resolution that reflect the recommendation of the Planning Commission.
7.D Recommendation on Ordinance Amending Title 10 Chapter 10.44.240 of the Sausalito Municipal Code, Formula Retail | Matthew Mandich, Principal Planner
SUMMARY: Conduct a public hearing on proposed Ordinance Amending Title 10, Chapter 10.44.240, Formula Retail, and adopt a resolution making a recommendation to the City Council.
RECOMMENDATION: Staff recommends the Planning Commission continue the item to a date uncertain.
